Terms of Service

These Terms of Service ("Terms") are an agreement between you and Our Picstory LLC ("Our Picstory," "we," "us"). They govern your use of the Our Picstory website and service at ourpicstory.com (the "Service"), where you can turn your photos into a printed softcover photo journal and an online reveal. By using the Service or placing an order, you agree to these Terms. If you don't agree, please don't use the Service.

Who can use the Service

You must be at least 18 years old, or the age of majority where you live, to place an order. You may use the Service on behalf of a minor in your care, but the adult account holder is responsible for the order and the content.

What we do

Our Picstory lets you upload a set of photos, add captions and a short story in your own words, and order a printed softcover photo journal that we produce through a third-party print and fulfillment partner. We also generate an online "reveal" of your journal that you can view and share. Printed journals are made to order.

Your photos and content

You keep all ownership of the photos, captions, voice recordings, and other content you upload ("Your Content"). You grant us a limited, non-exclusive license to store, process, reproduce, and transmit Your Content only for the purpose of operating the Service and producing and delivering your order, including sharing the necessary files with our print and fulfillment partner. We do not claim ownership of Your Content. We will not sell it, and we will not use it for advertising or to train our own AI. We use it only to create and deliver your journal, and to share it with the service providers needed to do that. This license ends when we no longer need your content to provide the Service, except for copies we must keep to meet legal or record-keeping obligations or that remain in routine backups.

You represent that you own or have permission to use Your Content, that you have the consent of any identifiable people in your photos, and that Your Content does not infringe anyone's rights or break any law.

Content that isn't allowed

You may not upload or order anything that is illegal, infringes someone else's intellectual property or privacy, is defamatory or harassing, or that sexualizes or exploits minors. Child sexual abuse material is strictly prohibited and will be reported to the authorities. We may refuse or cancel any order, and remove content, that violates these Terms.

Orders, pricing, and payment

Prices are shown on the Service and are in US dollars. Payments are processed by Stripe; we don't receive or store your full card details. When you place an order you authorize us (through Stripe) to charge your payment method for the order total, including any applicable sales tax and, where shown, shipping. We may correct pricing errors and cancel affected orders with a refund.

Printing, shipping, and returns

Journals are printed to order. Production and delivery times, shipping destinations, and our return and refund policy are described in our Shipping Policy and Refund Policy, which are part of these Terms.

Intellectual property

The Service itself (our name, logo, design, and software) belongs to Our Picstory LLC. These Terms don't give you any rights to our branding beyond using the Service as intended.

Service "as is"

We work hard to make the Service reliable and the print quality high, but the Service is provided "as is" without warranties of any kind, to the fullest extent the law allows. Colors on screen may vary slightly from the printed result.

Limitation of liability

To the fullest extent allowed by law, Our Picstory LLC will not be liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states don't allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to cover us for claims and costs arising from Your Content or your misuse of the Service, including claims that Your Content infringes someone's rights.

Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Georgia, and you agree to that venue.

Changes

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you. Continuing to use the Service after changes means you accept them.
